Article 1: Purpose
These general terms and conditions of sale govern the contractual relationship between LARDESPORTS, a brand of the TENNISPRO SAS group, and its customers. Any order validated by the consumer constitutes the consumer’s unconditional acceptance of these general terms and conditions of sale. These terms may be amended by TENNISPRO SAS. In that case, the applicable terms will be those in effect on the website when the consumer validates the order.
These general terms and conditions will apply from May 18, 2011.
Article 2: Contractual Information
In accordance with the provisions of the Consumer Code, the online store set up by Lardesports as part of its website provides the following information:
- Legal notices allowing Lardesports to be precisely identified.
- A presentation of the essential characteristics of the goods offered.
- An indication, in euros and including all taxes, of the price of the goods and services and delivery charges.
- An indication of payment, delivery, or fulfillment fees.
- The validity of the offer and its price.
- The existence of a right of withdrawal.
All information on the www.lardesports.com website is presented in French.
Article 3: Products
3.1. Prices
The prices of our products on the website are stated in euros, inclusive of all taxes and excluding delivery charges. They apply when the consumer validates the order (subject to availability).
Please note that if any items have an inconsistent price on the lardesports.com website (e.g., a racket priced at 1 euro, a reel of string priced at 4 euros, etc.), Lardesports may decide not to deliver the customer’s order, and the order will be canceled or returned to Lardesports by the customer if it was delivered by mistake.
Depending on the order amount and shipping destination, shipping charges may be added to the order total (see Delivery below).
Prices are subject to French VAT, and any change in the statutory VAT rate will be implicitly reflected in the prices of the products displayed on the Lardesports website on the date stipulated by the relevant implementing decree.
Items will be shipped excluding taxes if they are shipped to a country outside the European Union or to the DROM-COM. However, customers will be required to declare these items upon receipt.
The displayed public prices correspond to the retail prices recommended by the manufacturers.
3.2. Availability
The offers presented by Lardesports are valid only while stocks last. In the event of unavailability and in accordance with Article L 121-20-3 of the Consumer Code, you will be informed by email or telephone of any items that are out of stock.
The buyer will then have 72 business hours (excluding Saturdays, Sundays, public holidays and non-working days) from the purchase date to request cancellation, a refund of the amounts collected or an exchange of the order, up to an equivalent total price, by contacting us via our Help Center.
After this period, if you have not made any request, your order will be sent with the available items, and you will be charged only for those items.
Unavailable items will be refunded using the payment method used by the customer to pay for the order.
The customer may reserve goods ordered from our suppliers. If the order is incomplete, Lardesports reserves the right to ship the goods when all the items in the order are in stock. The customer may request immediate delivery of the incomplete order from Lardesports provided that they cover the shipping costs for the second shipment.
3.3. Conformity of Product Offers
The products offered comply with the French legislation in force and the standards applicable in France.
In accordance with Article L 111-1 of the Consumer Code, consumers may learn about the essential characteristics of the products they wish to purchase before placing their final order.
Professional players may play with racket specifications different from those displayed.
3.4. Discount Codes, Gift Cards and Gift Vouchers
Discount Codes
Simply enter the code in the “discount voucher” field located at the top of your cart, and the discount will be applied immediately. Please note that discount codes cannot be combined and always have a specified validity period.
Gift Cards
If you order a gift voucher on our website, we will email it to you with the discount code indicated on the voucher, which the recipient can use to spend the credit received. You will receive the voucher by email in PDF format, allowing you to print it and give it personally to the person of your choice.
Terms and Rules for Using a Gift Voucher
- Gift vouchers are considered by us to be a means of payment (to pay for part or all of your order). They are awarded exclusively in competitions in which you have participated (tournaments, competitions, championships, etc.).
- Each gift voucher has an expiration date. Be sure to use your voucher before its “expiry date.”
- Gift vouchers cannot be used for the following products: badminton shuttlecocks, tennis, squash or padel balls, gift vouchers, services (stringing), or products discounted during the statutory sales period.
- The value of the gift voucher must be used in a single transaction. If the voucher’s total value is not reached or used, the difference will be permanently forfeited.
E-Coupons
An “E-Coupon” is a type of “virtual” gift voucher that gives you a discount on your order (as a fixed amount or percentage). You will receive it by email in the form of a code, which you can use in the designated field during the order validation process.
In your cart, you must enter the EXACT code of your “E-Coupon” in the designated field > and its value will then be deducted from your order total to become the “net amount due” (that is, the amount remaining for you to pay).
3.5. Second-Hand Rackets
Second-hand rackets come from our “Test Rackets” program, which is why they show signs of wear that vary from one racket to another. However, all second-hand rackets are inspected and tested by our experts to guarantee their quality and performance before being offered for sale.
Second-hand rackets are covered by a 2-year legal conformity warranty. In the event of a defect unrelated to normal use, the customer may return the racket for an exchange or refund. The specific return conditions for second-hand rackets include a period of 30 days from the date of receipt of the racket (an extended statutory withdrawal period). If a product is repaired under this warranty, it will benefit from an additional six-month extension starting on the repair date.
To make a return, please contact our customer service via our Help Center or using our form on the Returns page.
3.6. Reservation as Part of a Return
As part of a return request, the customer may optionally request that a product be reserved. This reservation is offered as a commercial arrangement and does not constitute a legal obligation. The reservation is valid for a maximum period of 10 days from its confirmation by Lardesports.
If the returned product is not received within this period, the reservation will be automatically canceled at no cost to the Customer. This provision in no way affects the statutory right of withdrawal or the 30-day commercial period granted by Lardesports for returns.
If the reservation is canceled, the customer may still make a new purchase or benefit from the return terms set out in these General Terms and Conditions of Sale.
Article 4: Orders
4.1. Placing an order
These general terms and conditions of sale take effect on the date the order form is signed on our website www.lardesports.com. In accordance with the LEN Act of June 21, 2004, you have the option of checking the order details and its total price (price in euros, including all charges, and products plus delivery costs) and correcting any errors before confirming it to express your acceptance.
However, an order cannot be modified once it has entered the preparation process in our warehouses or stores, or for goods made and personalized according to the consumer’s specifications (stringing of rackets / grip installation / overgrip installation / protective tape installation / flocking / embroidery / …).
Lardesports will acknowledge receipt of your order electronically without delay.
4.2. Transfer of ownership
TENNISPRO SAS retains full ownership of the products sold until all amounts owed by the consumer in connection with the order, including costs and taxes, have been paid in full.
The transfer of ownership of an item purchased on www.lardesports.com by the consumer to a third party will not be handled by Lardesports, a brand of the TENNISPRO SAS group. Only the original purchaser of the item may claim the benefit of the provisions of these general terms and conditions of sale.
4.3. Proof of the transaction
Order forms and invoices will be archived on a reliable and durable medium that may legally be produced as evidence.
Article 5: WITHDRAWAL & WARRANTIES
In accordance with current legislation, our products benefit from the statutory right of withdrawal, which we have extended to a period of 30 days from receipt of the order. More information on this page.
Statutory Warranty of Conformity
The seller is required to deliver goods that conform to the contract and is liable for any lack of conformity existing at the time of delivery. The seller is also liable for any lack of conformity resulting from the packaging, assembly instructions, or installation when the installation was the seller’s responsibility under the contract or was carried out under the seller’s responsibility.
To conform to the contract, the goods must:
- Be fit for the use normally expected of similar goods and, where applicable:
- Correspond to the description provided by the seller and possess the qualities that the seller presented to the buyer in the form of a sample or model;
- Have the qualities that a buyer may legitimately expect in light of the public statements made by the seller or the manufacturer.
A two-year statutory warranty of conformity applies to your purchases, particularly tennis racquets. Therefore, if a racquet is defective for reasons other than normal use, the customer may return it to Lardesports. We will carry out a thorough inspection to determine whether or not it has a defect, after which it will be returned to the supplier. Indeed, under Articles 211-1 to 211-4 of the Consumer Code: Before March 18, 2016, the presumption that the defect pre-existed the delivery was six months from the date of delivery, for all goods. Consumers were not required to provide proof. For goods purchased after March 18, 2016, all defects in conformity appearing during the two years following purchase, except for second-hand goods for which the period remains six months, are presumed to have existed at the time of purchase. Consumers do not have to provide additional proof, as it is up to the professional seller to prove that the defect did not exist. You will then be contacted as soon as possible by the Lardesports after-sales service.
If coverage is accepted, the customer may, depending on the product, receive an exchange or repair from Lardesports. If the product cannot be repaired or replaced, or if the customer does not want a repair or replacement, a credit note for an amount equivalent to the purchase price of the item will be offered.
When Lardesports or one of its suppliers is liable, return shipping costs will be covered by providing a prepaid return label.
Credit notes issued as part of a customer return/cancellation are valid for one year only and will be automatically cleared after this period.
If one or more products are refused due to the products’ poor condition (for example: shoes worn after use, a racquet in blister packaging, etc.), reshipping the products will be charged at €6.90 for mainland France and €10 for other destinations (excluding heavy products).
Racquet Returns: if a racquet that was strung by us is returned, all services and consumables such as the string, stringing, grip or overgrip installation, protective tape, or logo application cannot be refunded.
Customized (personalized) racquets cannot be refunded or returned.
